Driver Agreement

Daily rental terms for drivers, covering deposit, usage rules, charging, damage liability and termination.

This document is a draft template prepared for internal review. It must be examined, adapted and executed under the guidance of a qualified advocate practising in India, and stamped as required under the applicable State Stamp Act before it becomes binding.

1. Engagement

1.1The driver rents the vehicle on a daily, weekly or monthly basis. This is a vehicle rental arrangement and not a contract of employment.
1.2The driver must hold a valid driving licence, badge where required, and clear police verification.

2. Rental and deposit

2.1Rental is payable daily in advance through the approved payment channel.
2.2A refundable security deposit is collected and returned within 15 days of vehicle handback, net of dues and damages.
2.3Rent-to-own drivers accrue credit as set out in the Rent-to-Own Schedule.

3. Vehicle use

3.1The vehicle may not be sub-rented, pledged, taken outside the permitted operating area, or driven by any other person.
3.2Charging and battery swapping only at approved points; tampering with the battery, motor or GPS is a material breach.
3.3Traffic violations, challans and fines are to the driver's account.

4. Damage, accident and termination

4.1Accidents must be reported within 2 hours; the driver bears the insurance deductible where negligence is established.
4.2Repeated default, tampering or misuse leads to suspension and repossession per the Driver Policy.
4.3Either party may terminate on 7 days' notice; the vehicle must be returned in the condition recorded at handover, subject to fair wear.

5. General

5.1Governing law: the laws of India. Courts at Bengaluru, Karnataka shall have exclusive jurisdiction, subject to the Dispute Resolution Policy.
5.2Notices shall be delivered by email to the addresses recorded in the Registration Form and by registered post for termination or settlement notices.
5.3No provision of this document creates an employment, partnership or agency relationship beyond what is expressly stated.
5.4If any clause is held unenforceable, the remainder survives unaffected.
5.5This document, together with the Registration Form and annexed schedules, constitutes the entire understanding between the parties.
